These Terms and Conditions (“Terms”) govern the access to and use of the services provided through the PoliNexus website (hereinafter referred to as the “Platform”). These Terms, along with any additional policies or guidelines, constitute a binding and enforceable agreement between PoliNexus (“we,” “our,” “us”) and the users (“you,” “your,” “User”) of the Platform.

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Platform.

1. PLATFORM

(a) Overview:PoliNexus offers its Users access to news, articles, current affairs, and related content (the “Content”) through its Platform. The Platform may also include other services or features designed to enhance user engagement and provide updated content across various subjects, including but not limited to politics, culture, and world events.

(b) User Access: You are granted access to the Platform for personal, non-commercial use. You must not use the Platform for any unlawful purposes or in any way that could damage, disable, or impair the Platform’s functionality. The Platform reserves the right to restrict or terminate your access at any time without notice for any breach of these Terms.

(c) Content Updates and Accuracy: The news and content on the Platform are updated regularly. While we strive for accuracy, PoliNexus does not guarantee the completeness, truthfulness, or currentness of any content and accepts no responsibility for errors or omissions. The information provided is for informational purposes only.

2. THIRD PARTY SERVICES

(a) Integration with Third-Party Services: The Platform may contain links to or integrate with third-party services, including external websites, tools, and applications (collectively, “Third-Party Services”). These services are not controlled by PoliNexus, and we are not responsible for the availability, content, or privacy practices of these Third-Party Services.

(b) Risks and Limitations: By using any Third-Party Services, you acknowledge and agree that any interactions with these services are entirely at your own risk. PoliNexus makes no representations or warranties regarding the accuracy, legality, or reliability of third-party content and services.

(c) Exclusion of Liability: PoliNexus disclaims all liability for any loss, damage, or inconvenience arising from your use of or interaction with Third-Party Services, including any harm resulting from viruses, malware, or security breaches.

3. USER RESPONSIBILITIES

(a) Accuracy of Information: As a User, you represent and warrant that all information you provide on or through the Platform is accurate, complete, and truthful. It is your responsibility to ensure that any updates or changes to your information are promptly communicated to PoliNexus.

(b) Compliance with Laws: You agree to comply with all applicable laws, regulations, and guidelines while using the Platform. This includes but is not limited to intellectual property laws, privacy laws, and laws relating to defamation or offensive content.

(c) Prohibited Uses: You must not use the Platform in any manner that:

• Infringes any intellectual property rights or proprietary interests of others.

• Harms or threatens the safety of minors or any other persons.

• Engages in any fraudulent, deceptive, or malicious activities.

• Attempts to interfere with the Platform’s security features or access controls.

(d) Security Responsibilities: You are solely responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must notify PoliNexus immediately of any unauthorized use of your account.

4. USE PAYMENTS AND FESS

(a) Free Access: Currently, the Platform is offered to Users free of charge. PoliNexus reserves the right to introduce subscription-based models or other payment mechanisms in the future, for which the terms will be outlined separately.

(b) Additional Fees: If paid features or services are introduced, the specific fees, payment terms, and billing procedures will be communicated to Users, and you must accept such terms to continue accessing the paid services.

(c) Refunds and Cancellations: PoliNexus will clearly state any refund or cancellation policies in case paid services or subscriptions are introduced. Users will be entitled to refunds only under the conditions specified.

5. INTELLECTUAL PROPERTY

(a) Ownership of Content: All content, including text, graphics, logos, videos, and other materials available on the Platform, are protected by intellectual property laws and are the exclusive property of PoliNexus or its licensors.

(b) License to Use: PoliNexus grants you a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial purposes only. You may not modify, distribute, or otherwise exploit the content without express permission.

(c) User-Generated Content: You may submit feedback, comments, or other content to the Platform. By doing so, you grant PoliNexus a worldwide, royalty-free, irrevocable license to use, modify, publish, and distribute that content without compensation.

6. TERM AND TERMINATION

(a) Duration of Agreement: These Terms will remain in effect as long as you continue to use the Platform. You may terminate your use of the Platform at any time by discontinuing access to the Platform.

(b) Termination by PoliNexus: PoliNexus reserves the right to suspend or terminate your access to the Platform at its sole discretion if you violate any of these Terms. Any termination will be effective immediately and may result in the loss of access to your account and any related content.

(c) Survival of Provisions: Certain provisions, such as those related to intellectual property, indemnity, and liability, shall survive the termination of these Terms.

7. DISCLAMERS AND WARRANTIES

(a) As-Is Basis: The Platform is provided on an “as is” and “as available” basis. PoliNexus makes no warranties or representations regarding the Platform’s availability, functionality, or content.

(b) Limitation of Liability: To the fullest extent permissible under applicable law, PoliNexus disclaims any liability for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the Platform, even if PoliNexus has been advised of the possibility of such damages.

(c) No Professional Advice: The content on the Platform is not intended to provide legal, medical, or other professional advice. Users should seek appropriate professional advice before taking any actions based on information from the Platform.

8. INDENITY

(a) User Indemnification: You agree to indemnify, defend, and hold harmless PoliNexus, its affiliates, officers, employees, and agents from any claims, losses, liabilities, or expenses arising from your use of the Platform or violation of these Terms.

(b) Indemnity for Content: You also agree to indemnify PoliNexus for any legal claims arising from content that you submit or share on the Platform, including violations of intellectual property or privacy rights.

9. CONSENT TO USE DATA

(a) Collection of Data: By using the Platform, you consent to the collection, use, and processing of your data as outlined in the PoliNexus Privacy Policy. This may include personal information, device information, usage data, and other technical data. 

(b) Use of Analytics Data: PoliNexus may collect anonymized data to analyze trends and improve the functionality of the Platform. This data may also be used for marketing or advertising purposes, subject to applicable laws.

(c) Legal Disclosure: PoliNexus may disclose your data to law enforcement or government agencies when required by law or in response to legal requests.

10. MODIFICATIONS

(a) Changes to Terms: PoliNexus reserves the right to modify, update, or amend these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of those changes.

(b) Discontinuation of Services: PoliNexus may modify or discontinue any part of the Platform without notice. We will not be liable for any loss or inconvenience caused by such modifications.

11. MISCELLANEOUS

(a) Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be in full effect.

(b) Waiver: The failure of PoliNexus to enforce any right or provision of these Terms will not constitute a waiver of such rights.

(c) Force Majeure: PoliNexus will not be held liable for any delay or failure to perform under these Terms if caused by events beyond its control, such as natural disasters, strikes, or governmental regulations.

12. LIMITATION TO LIABILITY

(a) No Liability for Damages: To the fullest extent permitted by applicable law, PoliNexus, its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages for lost profits, loss of data, or other intangible losses, even if PoliNexus has been advised of the possibility of such damages.

(b) Cap on Liability: In the event that PoliNexus is found to be liable for any damages, the total liability shall not exceed the amount you have paid to PoliNexus for accessing the Platform in the six months preceding the claim.

(c) No Responsibility for Third-Party Content: PoliNexus is not responsible for any content or information provided by third parties through the Platform, including links to external websites or services. We do not endorse, and are not responsible for, the accuracy, legality, or quality of third-party content, and your interactions with such content are at your own risk.
